These Terms of Service (the “Terms”) form an agreement between the person or business using Intek Invoice (“you”, “your”, or “User”) and Intek Ghana in relation to the Intek Invoice platform (“Intek Invoice”, the “Platform”, “we”, “us”, or “our”). By creating an account, accessing the Platform, or continuing to use it, you agree to these Terms.
1. The service
Intek Invoice is a business productivity platform that may allow Users to create invoices and receipts, maintain customer and catalogue records, publish a storefront, receive order requests, generate reports, share documents, connect Intek SMS, and use other business tools made available from time to time.
Features may differ by plan, account status, device, country, or release version. We may improve, replace, discontinue, or reorganise features where reasonably necessary to maintain or improve the service.
2. Accounts and account security
- You must provide accurate account and business information and keep it reasonably current.
- You are responsible for protecting your password, connected API credentials, device access, and any staff access you grant.
- You must tell us promptly if you believe your account has been compromised or used without permission.
- You are responsible for activity carried out through your account unless it resulted from a security failure within our control.
3. Your business records and documents
You remain responsible for the accuracy, legality, tax treatment, commercial terms, customer information, prices, discounts, taxes, payment instructions, products, services, and other content that you enter into Intek Invoice.
Intek Invoice provides tools for creating business documents. It does not certify that an invoice, receipt, tax field, storefront listing, or report satisfies every accounting, tax, regulatory, or industry requirement that may apply to your business. You should obtain professional advice where required.
4. Storefronts and customer order requests
A User may publish products and services through a public storefront. Unless a separate feature expressly states otherwise, Intek Invoice is not the seller of those products or services, is not a marketplace merchant, and is not a party to the transaction between a business and its customer.
Storefront order requests are intended to help customers communicate purchase interest to the business. The business remains responsible for confirming price, availability, delivery, fulfilment, returns, customer service, and any payment collected from its customer.
5. Intek SMS
Where you connect an Intek SMS account, SMS credits, Sender IDs, API access, and messaging are provided through the separate Intek SMS service. You are responsible for maintaining sufficient credits and using messaging features lawfully. Intek SMS purchases and usage may also be subject to terms shown on the Intek SMS platform.
6. Plans, trials, fees, and upgrades
- Some features may be free, trial-based, limited by usage, or available only on a paid plan.
- Plan limits, billing periods, prices, and included features may be displayed inside the Platform or on an invoice issued by Intek Ghana.
- Where a trial or subscription expires, some features may be limited or access may be suspended until the account is renewed or otherwise restored.
- Fees do not include taxes or charges that your business is legally required to bear unless expressly stated otherwise.
7. Acceptable use
You must follow our Acceptable Use Policy. You may not use the Platform for fraud, phishing, unauthorised messaging, illegal goods or services, malware, abusive access, impersonation, rights infringement, or conduct that could harm customers, other Users, Intek Ghana, or the Platform.
8. Your content and data
You retain ownership of the business content and records you submit to the Platform. You give us the limited permission necessary to host, process, display, back up, transmit, and otherwise handle that content for the purpose of providing, securing, supporting, and improving the service.
You are responsible for having an appropriate legal basis to enter, store, and communicate your customers’ personal information through Intek Invoice.
9. Availability, maintenance, and backups
We aim to keep Intek Invoice available and reliable, but uninterrupted access is not guaranteed. Maintenance, security work, internet failures, hosting incidents, third-party outages, or circumstances outside our reasonable control may temporarily affect the service.
We may maintain operational backups, but Users should retain copies of records that are legally or commercially critical to their businesses.
10. Suspension and termination
We may limit, suspend, or terminate access where reasonably necessary because of non-payment, material breach of these Terms, suspected fraud, security risk, unlawful use, abuse of platform resources, or a legal requirement. Where practical, we will provide notice or an opportunity to resolve the issue.
You may stop using Intek Invoice at any time. Stopping use does not automatically create a right to a refund. See our Refund & Cancellation Policy.
11. Intellectual property
Intek Invoice, its software, interface, platform branding, design components, documentation, and underlying technology remain the property of Intek Ghana or its licensors. These Terms do not transfer ownership of the Platform to you.
12. Limitation of responsibility
To the extent permitted by applicable law, Intek Invoice is provided as a business tool and we are not responsible for losses caused by inaccurate User-entered information, customer disputes, failed customer payments, business decisions based solely on reports, misuse of credentials, unsupported integrations, or events outside our reasonable control.
Nothing in these Terms excludes responsibility that cannot lawfully be excluded.
13. Privacy
Our handling of personal information is described in the Privacy Policy.
14. Changes to these Terms
We may update these Terms as the Platform changes or where legal, security, or operational requirements change. The current version will be published on this page with an updated effective date. Continued use after a material update may constitute acceptance of the revised Terms where permitted by law.
15. Governing law
These Terms are governed by the laws of the Republic of Ghana, subject to any mandatory rights or protections that apply to you under applicable law.
